Immigrated 28 Aug 1835 in 'Norfolk' (4) - Convict TAS AUS,67 [Convict number 80196 ]. William WARBY, was sentenced at Hythe, KENT ENG for 7 years and transported to Van Diemans Land (Tasmania). This was not his first offence. Maybe this is why the family came to Australia in 1839???
William's convict record states "Transported for stealing a Tame Rabbit. Gaol report: temper violent & bad, convicted & imprisoned. Hulk report: orderly, single, stated this offence, Stealing Rabbits, tried with Swain, once for Money 6 months, Single. Surgeon's report, Indifferent. On 18 September 1837 William was charged with Insolence & disobedience of orders and received 50 lashes. Received his Ticket of Leave in 1839, then on 12 July 1841he appeared in court again for a 'Ticket of Leave Breach of contract case' which is noted, the case was dismissed. William then received a Conditional Pardon No. 3247, on 16 September 1841 followed by his 'Free Certificate' No.860 in 1842." His convict record describes William as a List Shoemaker & Boatman, height...5 foot 6¼ inches, age...21, complexion...brown, Head...large & oval, hair... very dark brown, whiskers...very dark brown, visage...long, forehead...medium high, wrinkled, eyebrows...black, eyes...grey, nose...long, mouth...wide, chin...medium-long, remarks...mermaid inside left arm (tattoo). I have found a Mr Warby arriving at Boyd Town NSW 18 August 1845 per 'Union', from Launceston TAS. This information from the 'Sydney Morning Herald'. Unfortunately it does not give his christian name, but time wise it all fits with our William after finishing his sentence. It is then that William joined his sister, Celia and formed a relationship. It is known they were tenants at Cracknells Lane, Maitland in 1870 & 1871.

He adds:
My 3rd Great-Grandfather, James Warby (William and Celia's brother), joined the Church of Jesus Christ of Latter-day Saints (Mormons) and came to the United States, settling first in San Bernardino, California, then in Beaver Utah and finally in Manila, Utah. It being important to Mormons to know about their genealogy, he told his children and grandchildren about the common-law marriage of his sister and brother and it has been handed down through the line since. The story has been told several times by his descendants. Also, Celia (Selina, according to the Ship Neptune's records), is listed with the rest of the family on the ship's logs when they immigrated to Australia in 1939. After the death of John Chivington, Celia changed her name to Sarah Celia Woods (taking on her mother's maiden surname) and, being destitute, her brother, William, moved in with her and her 2 surviving children to support the family. Subsequently, they had seven children together.

The story was also told independently through one of William's descendants, Patricia Evans, who documented 15 generations of Warby's. She documents that only two of William and Celia's children survived this union without severe handicaps, which supports what would happen genetically with a brother-sister relationship. Handicaps requiring institutionalization continued to be prevalent in William and Celia's descendants for generations, but not in the children Celia had by John Chivington, nor in any of William's and Celia's brothers; and sisters' lines, as far as I have researched up to this point.
